Michael David Schimek

Michael D. Schimek concentrates his professional practice representing parties in complex commercial litigation disputes, including shareholder disputes, fraudulent real estate and investment scams, corporate officer and accountant misfeasance, and representing trust beneficiaries. Mr. Schimek has also represented employees, employers, brokers, and brokerage firms in employment related litigation matters.

Prior to joining Levitt LLP, Mr. Schimek was of counsel with the New York office of Cahill & Gambino, LLP and was a partner with Doyle, Restrepo, Harvin & Robbins, LLP in Houston, Texas.

Defending investment banking firm from multi-million dollar breach of contract claim relating to its investment banking services.

Defending brokerage firm from multi-million dollar insider-trading claims.

Defending “big four” accounting firm from fraud allegations in $100 million dollar lawsuit involving collapse of oil trading company.

Defending global well service company in numerous multi-million dollar commercial disputes, including shareholder disputes, indemnity claims by former corporate officers, and employment claims.

Defending officers of a hotel business from breach of fiduciary claims by former shareholder and corporate officer.

Prosecuting multi-million dollar breach of fiduciary and fraud claims against real estate developer for physician investors.

Prosecuting wrongful termination claim before the Financial Industry Regulatory Authority

Prosecuting environmental contamination claims for estate administrator against environmental clean-up companies.

Mr. Schimek graduated magna cum laude from Texas A&M University with a BBA, and with honors from Baylor University School of Law. While at Baylor, he served on the Baylor Law review as Lead Articles Editor. After graduation, Mr. Schimek clerked for the Honorable Walter S. Smith, Chief Judge of the United States District Court for the Western District of Texas.

Mr. Schimek is licensed to practice before the United States District Courts for the Southern and Eastern Districts of New York and the Southern, Western and Northern Districts of Texas. Mr. Schimek has also served as an officer on the Special Olympics Committee (Attorney Section), New York State Bar Association Rules Committee, and Houston Volunteer Lawyers Program.
